Terms of Service

These terms are an agreement between you and Exystems, LLC (“we”, “us”) about the Morse Mastery app (the “App”) and the website at morsecodemastery.com. By installing or using the App you accept them. If you do not, please do not use it.

1. Your licence

We give you a personal, non-exclusive, non-transferable licence to use the App on devices you own or control, for your own learning. You may not copy, resell, redistribute or reverse-engineer the App or its course content, except where the law allows it regardless of these terms. We keep all rights in the App, its course, its games, its sounds and its artwork.

2. The stores’ terms

You get the App from Google Play or the Apple App Store, and their terms apply alongside these. If you got the App from Apple, Apple is not responsible for the App or its support, and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

3. The free start and the one-time unlock

  • The first sections of the course and some features are free, with no time limit.
  • The full course is a single in-app purchase (currently $8.99 in the US; the store shows your local price). It is not a subscription and does not renew.
  • The purchase belongs to your store account. You can restore it on another device signed in to the same account, at no charge. A purchase on Google Play does not carry over to the App Store, or the other way round.
  • Payment, refunds and cancellations are handled by the store, under its rules. We cannot issue refunds ourselves.
  • We may improve, rearrange or add to the course and games. If we ever remove a substantial part of what you bought, we will try to replace it with something of equal value.

4. The SOS beacon is not an emergency device

The App can send SOS and other messages as sound, light and vibration. It is a learning and signalling aid, not certified safety equipment. It depends on your phone’s battery, speaker, flash and settings, and nobody may be watching or listening. Never rely on it instead of calling your local emergency number, or instead of proper equipment such as a personal locator beacon, flare or marine radio.

5. Using the App responsibly

Keep the volume at a comfortable level, especially with headphones. Do not point the flash at people’s eyes or at drivers, pilots or vessels in a way that could confuse or endanger them; flashing SOS when there is no emergency may be unlawful where you are. Do not use the App while driving.

6. Amateur radio

The course includes a simulated radio contact. Transmitting on real radio frequencies needs a licence in most countries; the App does not grant or replace one.

7. Your progress

Your progress is stored only on your device (see the privacy policy). We cannot recover it if it is lost. Use Settings → Export to keep a copy.

8. Disclaimer

THE APP AND WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE EXTENT THE LAW ALLOWS. WE DO NOT PROMISE THAT THE APP WILL BE ERROR-FREE OR THAT YOU WILL REACH ANY PARTICULAR SPEED OR SKILL.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXYSTEMS, LLC IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS OR GOODWILL, ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE APP OR WEBSITE. OUR TOTAL LIABILITY FOR ALL CLAIMS IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM, OR FIVE U.S. DOLLARS. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT ALL APPLY TO YOU. NOTHING HERE LIMITS RIGHTS YOU HAVE AS A CONSUMER THAT CANNOT BE WAIVED.

10. Ending the agreement

You can stop at any time by uninstalling the App. If you break these terms, your licence ends automatically.

11. Changes

We may update these terms. The date above will change, and continuing to use the App after a change means you accept the new terms.

12. Governing law

These terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict-of-laws rules. Disputes go to the state or federal courts in Allegheny County, Pennsylvania, unless the law where you live gives you the right to bring them at home.
